Terms & Conditions

A legal disclaimer

These Terms and Conditions ("Agreement") govern the booking of Ceymphony ("the Band") for live
musical performances. By paying a deposit or confirming a booking in writing, the Client agrees to be
bound by these terms.

1. Booking & Deposits

A booking is only considered "Confirmed" once a non-refundable deposit (as specified in the quote)
has been received. The remaining balance must be settled no later than 14 days prior to the event
date, unless otherwise agreed in writing.

2. Performance & "Own Sound" Intellectual Property

Ceymphony provides a unique musical experience incorporating original arrangements, mashups, and proprietary "own sounds."

  • The Band retains all intellectual property rights to its unique arrangements and original compositions performed during the event.

  • Any audio or video recording of the performance for commercial use requires prior written consent from the Band.

3. Technical Requirements (The Rider)

The Client is responsible for ensuring the venue provides:

  • A safe, flat, and dry performance area (minimum 5m x 3m recommended).

  • At least two independent 13-amp power sockets within 5 meters of the performance area.

  • Parking for the Band's vehicles and reasonable access for loading/unloading equipment.

  • A secure, private changing area (not a public restroom).

Note:  Failure to provide a safe electrical supply or adequate shelter for outdoor events may result in the Band being unable to perform to protect equipment and member safety. No refund will be given in this instance.

4. Cancellations & Postponements

If the Client cancels the booking, the following fees apply:

  • 90+ days before event: Loss of deposit only.

  • 30-89 days before event: 50% of the total remaining balance is due.

  • Less than 30 days before event: 100% of the total balance is due.

Postponements are treated as cancellations unless the Band is available for the new date and a new
contract is issued.

5. Performance Times

Performance timings are agreed upon at the time of booking. If the event runs behind schedule, the Band will make reasonable efforts to accommodate, but is not obligated to extend the performance beyond the agreed finish time. Late starts caused by the venue or Client do not result in a reduction of
the fee.

6. Force Majeure

The Band shall not be liable for failure to perform due to circumstances beyond their reasonable control, including but not limited to: illness of key members, equipment failure, extreme weather, or government restrictions. In such unlikely events, the Band will attempt to provide a suitable replacement or offer a refund of the balance paid.

7. Client Conduct

The Client is responsible for the conduct of their guests. The Band reserves the right to cease performance if equipment is at risk of damage or if Band members are subjected to physical or verbal abuse.
